Over 5,000 digital accessibility lawsuits were filed in 2025 - an 8% increase from 2024. Web accessibility cases now account for 36% of all ADA Title III lawsuits filed in federal court.

Which industries are targeted

E-commerce dominates at 70% of all filings. Restaurants and food service account for 21%. Healthcare, finance, and education make up the remainder.

The new ADA Title II deadline (April 24, 2026) means public entities with populations over 50,000 must now have WCAG 2.1 AA conformant websites and apps.

The European Accessibility Act

The EAA has been enforceable since June 28, 2025. Any business selling digital services to EU consumers must comply with EN 301 549 (which maps to WCAG 2.1 AA). Penalties: up to 3 million euros, product/service removal from market.
