5,114 ADA Lawsuits in 2025: Updated Data and 2026 Trends

In April we published an analysis based on early 2025 data showing 3,948 ADA digital accessibility lawsuits. The final count for 2025 was significantly higher: 5,114 federal lawsuits, an increase of roughly 24% over 2024.

Here is the updated picture, including early 2026 filing patterns.

2025 final numbers

  • 5,114 ADA web accessibility lawsuits filed in federal court
  • ~8,667 total ADA Title III lawsuits (web accessibility accounts for 36% of all filings)
  • 24% year-over-year increase from 2024
  • 77% of web accessibility lawsuits targeted e-commerce businesses

The growth trend has been consistent for six years running. There is no indication it is slowing.

2026 filing patterns

January 2026 saw 347 ADA website lawsuits filed, equating to roughly 11 per day. If the pace holds, 2026 will exceed 4,000 federal filings.

The early 2026 data reveals three notable shifts:

Florida overtook New York

Florida led all states with 88 filings in January 2026, surpassing New York for the first time. California followed with 62 filings, and New York and Illinois each reported 60.

This geographic shift matters because Florida's legal environment is increasingly plaintiff-friendly for ADA cases, and the trend suggests filing activity is diversifying beyond the traditional New York concentration.

Industry targeting is narrowing

Restaurant and food service led with 121 lawsuits in a single month, followed by fashion and apparel (74) and beauty and body care (34). E-commerce broadly remains the dominant target at 77% of all filings.

The concentration in restaurants reflects the April 2026 ADA Title II deadline for state and local government websites, which has increased awareness of web accessibility requirements across all sectors.

Litigation is highly concentrated

The most striking pattern: the top 10 plaintiff law firms were responsible for 322 of 373 ADA website lawsuits filed in March 2026. That is 86% of all filings from just 10 firms. In January, just 16 individual plaintiffs accounted for 51% of all cases.

This concentration has implications. A small number of firms are driving the vast majority of litigation, and they are systematically identifying non-compliant sites. If your site has known accessibility issues, it is not a question of whether a plaintiff firm will find it, but when.

What the data means for agencies

If you build or manage websites for clients, these numbers create a commercial imperative:

Client education. Most businesses still do not know they are at risk. The data shows that e-commerce sites, restaurants, and healthcare businesses are the most targeted. If your clients are in these sectors, they need to hear about this from you, not from a demand letter.

Proactive scanning. Running accessibility scans before a lawsuit arrives is orders of magnitude cheaper than responding to one. The median demand letter settlement is around $10,000 to $30,000. A year of accessibility monitoring costs a fraction of that.

Documentation matters. Courts look at good-faith efforts. A business that can show consistent monitoring, documented remediation, and an accessibility statement is in a significantly stronger position than one that did nothing.

The cost of doing nothing

A useful way to frame this for clients:

  • Demand letter settlement: $10,000 to $30,000
  • Defended lawsuit: $50,000 to $150,000 in legal fees
  • Class action settlement: up to $400,000
  • Annual accessibility monitoring: typically $350 to $1,550 per year

The monitoring cost is a rounding error compared to the litigation risk. And unlike a lawsuit settlement, monitoring actually fixes the underlying issues.
